FOR IMMEDIATE RELEASE AFTER A LEGAL STRUGGLE WITH A MULTI-NATIONAL COMPANY, LOCAL COMPANY NOW READY TO OFFER FRANCHISE OPPORTUNITIES e-Services, a local Lafayette company, is in the process of introducing franchising opportunities after undergoing a lengthy legal struggle with IBM's legal services. The battle began in 2003, when owner, Rhonnie McCauley, filed to trademark her logo in order to deliver a complete franchising package to expand her business. Years before, Rhonnie had already branded her company with the "e-Services" name, where the lowercase "e" represented the personal and corporate services her company provides. Having already created her website and marketing materials with this name, she believed filing for a trademark for the logo and name would be a simple and next logical step in delivering e-Services complete business plan. Rhonnie received a certified letter from New York entitled "Infringement of IBM "e" Trademark." The letter strongly stated that the e-Services "e" was highly similar to IBM's "e" logo. Therefore, IBM's lawyers attempted to conclude that e-Services use of the small "e" was likely to cause confusion and dilute IBM's rights in its "e" logo. Despite ordering a "cease and desist" order, the legal firm did offer to help with the "recreation of an acceptable alternative to "e"-Services." While e-Services legally argued that IBM's "e" trademark does not give exclusive rights across every business application (rather it is limited to their use of hardware and software services), Rhonnie realized that she could not uphold the huge financial responsibility it would take to fight against IBM. Creatively, e-Services rebranded their logo - the small "e" (that IBM corned the market on) was now placed inside a bouncing ball. This little change was sufficient for IBM - their legal team, upon receiving a copy of the new logo, sent official notification that they approved of it. On Dec. 13, 2005, the e-Services logo was finally approved and registered with the Patent Trademark Office (PTO) for two classes: the 44 class, covering their Pet Sitting Services, and the 45 class, for running errands for others, personal arrangements, house sitting, personal assistance, Senior care etc. e-Services is now ready to finalize their franchising packages - legally approved by the PTO and IBM's lawyers.
